Jim has extensive experience in litigation, arbitration and mediation for construction, surety and complex commercial disputes. Jim has served as lead counsel in multi-party construction and surety litigation in state and federal courts in arbitration. Recent cases include:
 
Successful defense of claims against a building contractor and its insurance carriers exceeding $8 million involving the construction of a multi-building condominium complex. This was a six-month jury trial that resulted in a no-cause verdict in our client’s favor in 2004.
Awarded 100% of delay/impact claim with pre-award interest on behalf of a commercial surety and successful defense of delay claims exceeding $1 million involving the construction of a public school. This case was decided through a 40-session multi-party arbitration.
Successfully defended a design professional in multi-party litigation involving the collapse of a hotel/casino parking garage in Atlantic City, NJ, negotiating a highly favorable settlement on behalf of our client. The overall settlement was touted by plaintiffs’ counsel to be the largest settlement of a construction personal injury claim in U.S. history.


 

Jim has provided advice and counsel on a wide variety of construction and surety related issues to owners/developers, general contractors, subcontractors and sureties. He has successfully resolved defaults on major construction projects on behalf of commercial sureties.

Jim has served as corporate counsel and regional manager of a large building products/construction contracting company and is a former Assistant Essex County Prosecutor. He is a member and past president of the Morris Hills Regional Board of Education. He also serves as a member of the Panel of Arbitrators for the American Arbitration Association.
